Considera-se trabalho em regime de tempo parcial aquele cuja dura\u00e7\u00e3o n\u00e3o exceda a trinta horas semanais, sem a possibilidade de horas suplementares semanais, ou, ainda, aquele cuja dura\u00e7\u00e3o n\u00e3o exceda a vinte e seis horas semanais, com a possibilidade de acr\u00e9scimo de at\u00e9 seis horas suplementares semanais.<\/p>\n<p style=\"text-align: justify;\">Art. 443 \u00a7 3\u00ba Considera-se como intermitente o contrato de trabalho no qual a presta\u00e7\u00e3o de servi\u00e7os, com subordina\u00e7\u00e3o, n\u00e3o \u00e9 cont\u00ednua, ocorrendo com altern\u00e2ncia de per\u00edodos de presta\u00e7\u00e3o de servi\u00e7os e de inatividade, determinados em horas, dias ou meses, independentemente do tipo de atividade do empregado e do empregador, exceto para os aeronautas, regidos por legisla\u00e7\u00e3o pr\u00f3pria.\u201d<\/p>\n<p style=\"text-align: justify;\">O Relat\u00f3rio Anual de Informa\u00e7\u00f5es Sociais (RAIS), mostra o <a href=\"https:\/\/static.poder360.com.br\/2020\/10\/Sumario-Executivo_RAIS-2019.pdf\" target=\"_blank\" rel=\"noopener\">crescimento exponencial<\/a> dos contratos de trabalho que n\u00e3o seguem escala cont\u00ednua:<\/p>\n\n<h6>Figura2. Embora esteja em crescimento, ainda h\u00e1 muitas d\u00favidas trabalhistas que rondam o contrato de trabalho intermitente.<\/p>\n<p style=\"text-align: justify;\"><strong>As novas modalidades e os direitos trabalhistas<\/strong><\/p>\n<p style=\"text-align: justify;\">Tanto o teletrabalho quanto o trabalho realizado em regime parcial seguem as regras comuns de c\u00e1lculo para cumprimento dos direitos trabalhistas. Quando pactuado o regime intermitente, a diferen\u00e7a est\u00e1 no pagamento: a cada convoca\u00e7\u00e3o, encerrado o per\u00edodo de trabalho, devem ser pagos os vencimentos proporcionais.<\/p>\n<p style=\"text-align: justify;\">A remunera\u00e7\u00e3o, f\u00e9rias e 1\/3 proporcionais, 13\u00ba sal\u00e1rio proporcional, repouso semanal remunerado e demais adicionais legais, inclusive horas extras, s\u00e3o pagas imediatamente no t\u00e9rmino do per\u00edodo. O colaborador tem direito ao gozo das f\u00e9rias ap\u00f3s 12 meses de presta\u00e7\u00e3o de servi\u00e7os, por\u00e9m n\u00e3o remuneradas, haja vista que recebe os valores garantidos por lei ao longo da execu\u00e7\u00e3o do trabalho.<\/p>\n<p style=\"text-align: justify;\">Todas as quest\u00f5es que n\u00e3o s\u00e3o expl\u00edcitas na legisla\u00e7\u00e3o vigente ficam a cargo da jurisprud\u00eancia decorrente das decis\u00f5es dos ju\u00edzes.
